American Federalism Essay Federalism, by definition, is the division of government authority between at least two levels of government. In the United States, authority is divided between the state and national government. Advocates of a strong federal system believe that the state and local governments do not have the sophistication to deal with the major problems facing the country (Encarta.com). Even before the Constitution was ratified, strong argument were made by Alexander Hamilton, John Jay, and James Madison in the Federalist Papers urging the inclusion of a federal form of government to replace the failed confederation. In Federalist Paper No. 9 Hamilton states, This form of government is a convention by which several smaller states agree to become members of a large one, which they intend to form. It is s kind of assemblage of societies that constitutes a new one, capable of increasing, by means of new associations, until they arrive to such a degree of power as to be able to provide for the security of a united body (Usinfo.state.gov). The people of the United States needed a central government that was capable of holding certain powers over the states. Those who feared that the federal government would become too strong were assured by Madison in Federalist No. 14 that in the first place it is to be remembered that the general government is not to be charged with the whole power of making and administrating lawsThe subordinate governments, which can extend their care to all those other objects which can be separately provided for, will retain their due authority and activity (Usinfo.state.gov). The necessary and proper clause was included in the Constitution to allow for an active and powerful government. It is also known as the Elastic Clause and basically stated that the national government had the ability to pass any law that was necessary and proper to carry out national business. John Marshall expanded the interpretation of the necessary and proper mainly through the Supreme Court decision in McCulloch v. Maryland. His decision that a state could not tax an agency of the national government was not the only outcome of the court case. Marshall took the opportunity to say that even though it is not mentioned in the Constitution, the national government has the right to charter a national bank (Usinfo.state.gov). The first era of federalism is dual federalism. Dual federalism is the belief that having separate and equally powerful levels of government is the best arrangement. One major leader during this era was Roger B. Tanney, who was the head of the Supreme Court. During this era, there was heated political debate on the issue of slavery. The Dred Scott v. Sanford decision in 1857, this was the first decision to take powers away from the national government. During this time, the Civil War occurred (Nvcc.com). After the Civil War, with the passage of the Thirteenth, Fourteenth, and Fifteenth Amendments became sources of power for the national government when it came to its jurisdiction over the states. By passing laws against slavery and allowing equal protection under the law, the national government gave itself the power to enforce those laws and therefore enhanced authority over the states. The Thirteenth Amendment abolished slavery and in Section 2 stated that Congress shall have the power to enforce this article by appropriate legislation. By adding Section 2 to the amendment, Congress was simply ensuring their supremacy over the state governments. Among other things, the Fourteenth Amendment guarantees equal protection under the law to all citizens. Since all citizens are guaranteed protection, it is left up to the national government to make sure all citizens are receiving these rights. Even though many thought that the Fourteenth Amendment meant that the Bill of Rights was nationalized, its interpretation by the Supreme Court was much different. Just as in the Thirteenth Amendment, the Fourteenth in Section 5 is given the power to enforce the article. Tycho Brahe Essays - Copernican Revolution, Tycho Brahe, Philippists Tycho Brahe Tycho Brahe Tyge (Latinized as Tycho) Brahe was born on 14 December 1546 in Skane, then in Denmark, now in Sweden. He was the eldest son of Otto Brahe and Beatte Bille, both from families in the high nobility of Denmark. He was brought up by his paternal uncle Jrgen Brahe and became his heir. He attended the universities of Copenhagen and Leipzig, and then traveled through the German region, studying further at the universities of Wittenberg, Rostock, and Basel. During this period his interest in alchemy and astronomy was aroused, and he bought several astronomical instruments. In 1572 Tycho observed the new star in Cassiopeia and published a brief tract about it the following year. In 1574 he gave a course of lectures on astronomy at the University of Copenhagen. He was now convinced that the improvement of astronomy hinged on accurate observations. After another tour of Germany, where he visited astronomers, Tycho accepted an offer from the King Frederick II to fund an observatory. He was given the little island of Hven in the Sont near Copenhagen, and there he built his observatory, Uraniburg, which became the finest observatory in Europe. Tycho designed and built new instruments, calibrated them, and instituted nightly observations. He also ran his own printing press. The observatory was visited by many scholars, and Tycho trained a generation of young astronomers there in the art of observing. After a falling out with King Christian IV, Tycho packed up his instruments and books in 1597 and left Denmark. After traveling several years, he settled in Prague in 1599 as the Imperial Mathematician at the court of Emperor Rudolph II. He died there in 1601. His instruments were stored and eventually lost. Tycho Brahe's contributions to astronomy were enormous. He not only designed and built instruments, he also calibrated them and checked their accuracy periodically. He thus revolutionized astronomical instrumentation. He also changed observational practice profoundly. Whereas earlier astronomers had been content to observe the positions of planets and the Moon at certain important points of their orbits. Tycho and his cast of assistants observed these bodies throughout their orbits. As a result, a number of orbital anomalies never before noticed were made explicit by Tycho. Without these complete series of observations of unprecedented accuracy, Kepler could not have discovered that planets move in elliptical orbits. Tycho was also the first astronomer to make corrections for atmospheric refraction*. In general, whereas previous astronomers made observations accurate to perhaps 15 arc minutes, those of Tycho were accurate to perhaps 2 arc minutes, and it has been shown that his best observations were accurate to about half an arc minute. Tycho's observations of the new star of 1572 and comet of 1577, and his publications on these phenomena, were instrumental in establishing the fact that these bodies were above the Moon and that therefore the heavens were not immutable as Aristotle had argued and philosophers still believed. The heavens were changeable and therefore the Aristotelian division between the heavenly and earthly regions came under attack (see, for instance, Galileo's Dialogue) and was eventually dropped. Further, if comets were in the heavens, they moved through the heavens. Up to now it had been believed that planets were carried on material spheres (spherical shells) that fit tightly around each other. Tycho's observations showed that this arrangement was impossible because comets moved through these spheres. Celestial spheres faded out of existence between 1575 and 1625. Tycho developed a system that combined the best of both worlds. He kept the Earth in the center of the universe, so that he could retain Aristotelian physics The Moon and Sun revolved about the Earth, and the shell of the fixed stars was centered on the Earth. But Mercury, Venus, Mars, Jupiter, and Saturn revolved about the Sun. He put the (circular) path of the comet of 1577 between Venus and Mars. They include frictional unemployment, structural unemployment, natural rate of unemployment and demand deficient unemployment. Frictional unemployment reflects the time taken by individuals to find and get settled in their new jobs. Structural unemployment is the difference between the skills and other attributes possessed by the labor force and what the employers actually demand. This type of unemployment considers employees who are undergoing re-training in order to start a new job as being unemployed. It is usually increased by technological changes. Natural rate of unemployment is the sum total of frictional and structural unemployment. It is considered to be the lowest rate of unemployment that is expected to be achieved by a stable economy. Demand deficient unemployment is the level of unemployment which is beyond the natural rate unemployment. Causes of unemployment According to Keynesian economics, unemployment results from deficit in effective demand for both goods and services in an economy (US Bureau of Labour Statistics, 2010). As the human race and daily life becomes more advanced, there are times when it becomes necessary to consider the variables that influence our society. These variables-religion, tradition, environment, etc. - make up the culture of a society. New technologies are created when the people living in a particular society feel that one of these variables needs to be expanded upon or changed (Discovery Channel, Feb. 11). A particularly relevant example is the United States Space program. The space program grew out of the Cold War in the 1960’s. The technological needs of this effort, specifically small computers, heat resistant ceramics, radio communication, and power cells lead to the products and devices that we enjoy today. Societies, with their specific cultural needs, influenced the development of their own technology. For example, the Chinese in ninth century A.D. were fascinated with perfumes, noxious bombs, explosions, gases, and smoke. They burned incense and fumigated their houses for health as well as spiritual reasons. In the Chinese culture, smoke and loud explosions were connected to the spiritual and supernatural world. Chinese priests invented gunpowder by combining charcoal, saltpeter, and sulfur. Their military-centered society saw the advantages gunpowder gave them in battle situations as well. The Chinese were the first to invent land mines, fire lances, and grenades. When Europeans learned about gunpowder, they began experimenting (Teresi, 355-56). Before long, cannons and guns were invented and warfare would never be the same aga... ... purposes, would the history of war have changed? It is probable that gunpowder would have eventually been invented, but who would have discovered it and when? What was their culture like; would the smoke and fumes make them feel connected to supernatural beings or would gunpowder strictly be used for war? Unseasonable rains, contractor delays, weather issues, disagreements between architects and the school board were some factors contributing to the delays. With his extensive roles and experience, the school board hired Merv, President of Lily’s Advisors, to advise them about how to proceed under their tense circumstances Merv investigated the situation and submitted a confidential document, on the First High School this was in February 1999. The performances to date of Meyerhoff, the main contractor and Stewart and Sons, the architectural firm, were critically evaluated. The major findings were that Stewart and Sons failed to control the scheduling properly and that it was making an unusually large profit for its administrative function. Merv was familiar with Stewart & Sons and was able to write about their methods of execution. The school board asked Stewart and Sons to renegotiate because of the findings of the report, but gave them the impression that it was based on the construction delays. The content of the report remained undisclosed. After two months of very difficult negotiation, all groups signed an amended contract on June 30, 1999. All major issues were settled and they were able to proceed to the construction of the second high school. The new amended contract had further delays as the groups found that the excessive compromising that was done was becoming irksome. The school board had thought Stewart and Sons was very uncompromising and aggressive. Disagreements continued between the school board and the construction and architectural firms during the next eight months. At this point, Stewart and Sons decided to hire Lily as a consultant. Stewart had worked with Lily before. They met and Merv disclosed that he had submitted an evaluation of the contract to the school board in a document, after making a proposal on September 24, 2000. The negative aspects of the report were never revealed. Sam Shapiro, the architect’s lawyer, contacted Merv about the document submitted and the potential conflict of interest which could arise but Merv denied any conflict of interest. Shapiro and the representatives from Stewart gave Merv a contract to sign for his services on November 8, 2000. The situation further deteriorated during the next 4 months and the school board sued Stewart and Sons. The lawyers representing Stewart and Sons saw the confidential document, as was required by the law. This outraged Stewart and Sons as they viewed the document as impugning the company’s integrity and honesty. Stewart and Sons viewed it as a case of conflict of interest and not one with just the potential. Merv believed otherwise. He explained that he recognized a potential conflict of interest and devised measures to prevent it. Merv was convinced of his flawless strategy and believed he had insulated the teams sufficiently to avoid this and, in any case, the construction of the second school was a new project. Stewart and Sons informed him that they would not pay the $102,500 that was due on the contract. After contemplating the amount of money to be spent on the case, he decided to proceed to prove otherwise.

Labor Unions Must Fight Globalization or Become Extinct Essay

â€Å"Two world wars [along with Roosevelt’s] â€Å"New Deal† had indeed, made government big.† (Moody, 2007, p. 114) Government became â€Å"big† because of its controlling interest in business and labor. The reason for this interest is that government was dealing with a failed economy and had two world wars to contend with. These wars required a continual supply of food and supplies to be produced. In order to guarantee supplies to be free of interruption, it required government gaining control over every major industry and labor in order to keep harmony. Along with this harmony, it became instrumental in creating the steady supply of profits for businesses. It also helped in producing wage equality and social services for workers. As the 1980’s entered little did labor know politics was about to take on yet another whole new personality. This personality was brought in with the incoming of the new President Ronald Reagan; he had his own idea of operating the country on neoliberal politics. This form of politics has continued and is still operating today. Not only is it creating havoc with the U.S. labor force, but has moved across International borders virtually destroying everything it touches. â€Å"Organized labor [finally realized they were] technically and theoretically unprepared for Reagan’s assault. [Up to now labor has been] unable to conceptualize . . . or even generate the social force necessary to resist [this] new conception of labor relations.† (Fletcher Gapasin, 2008, p.46) In order for labor to defend itself against neoliberal globalization, certain questions must be answered.
